1. Parties
These Terms and Conditions govern the relationship between Vinho Sem Medo (hereinafter "VSM" or "Platform") and partner wineries (hereinafter "Winery" or "Partner") who subscribe to a membership plan to list and sell their wines on the marketplace vinhosemmedo.pt.
2. Service provided
VSM provides the Winery with a space on the online marketplace to list wines, access to an order management dashboard, coverage under the VSM Guarantee, and visibility in the platform's combined promotional activities.
3. Membership and payment
The available membership plans are:
- Annual — €10/mo · total €120/year · VAT included
- 6-month — €15/mo · total €90/6 months · VAT included
No reference limits. No sales commissions.
Payment is made in full at registration, by credit/debit card through the Stripe platform. All plans are non-refundable. By completing registration, the Winery confirms it has read and accepts these Terms.
4. Renewal
Plans do not renew automatically. Before the end of the membership period, VSM will contact the Winery to confirm renewal interest. If not renewed, the winery page is suspended at the end of the paid period.
5. VSM Guarantee — Winery obligations
The VSM Guarantee allows the buyer to open one bottle and, if not satisfied, return the remaining five. Coverage of this guarantee is included in the membership. The Winery accepts:
- Receive returned bottles in good transport condition
- Return shipping cost is borne by the buyer
- The value of returned bottles is not refunded by the Winery to the buyer — this process is managed by VSM
6. Winery obligations
- Keep wine data (stock, prices, availability) updated in the dashboard
- Process and dispatch orders within 3 business days
- Have an active and verified Stripe account to receive payments
- Comply with all applicable legislation on the sale and shipment of alcoholic beverages in Portugal
7. VSM obligations
- Activate the Winery page within 24 business hours of receiving the complete registration
- Maintain the marketplace operational and publicly accessible
- Carry out marketplace promotional activities while the membership is active
- Manage the return process under the VSM Guarantee
8. Intellectual property
The Winery grants VSM a non-exclusive licence to use the images, texts and wine descriptions provided, solely for presentation and promotion purposes on the marketplace and VSM's communication channels.
9. Suspension and termination
VSM reserves the right to suspend or remove a Winery page in cases of non-compliance with these Terms, false information, or activity that damages the marketplace's reputation. In such cases there will be no refund of the membership.
10. Applicable law
These Terms are governed by Portuguese law. In case of dispute, the courts of Lisbon shall have jurisdiction.
